A Solid Defense Against Drug Charges

It’s never good when police find drugs, but it’s not the end of the story. Did they jump to conclusions they can’t prove? Did they have a legitimate reason to stop or search you in the first place?

If you are charged with drug offenses in the Sioux Falls area, turn to DeMatteo Law Firm for fierce protection of your rights. My job is to keep law enforcement in check and prevent you from being overly punished.

Drug Possession And Drug-Related Crimes

I am criminal defense lawyer Lyndsay DeMatteo. I have defended people of all walks of life who were arrested for drugs, including:

  • Possession of marijuana or drug paraphernalia
  • Possession of meth, heroin, fentanyl and other controlled substances
  • Possession of prescription-only meds (oxycodone, ritalin, etc.)
  • Possession with intent to distribute
  • Cultivating or manufacturing drugs
  • Drug trafficking and criminal conspiracy
  • Weapon offenses and weapon enhancements

Drug Crime Defenses

South Dakota law enforcement gets overzealous in the war on drugs. Although marijuana has been decriminalized in other states, it is still illegal in South Dakota and marijuana offenses get treated like felonies. I work to draw the distinction between weed and more hardcore substances.

Drug offenses in general are frequently overcharged. Simple possession, for example, gets prosecuted as possession with intent. I try to talk to the district attorney when it seems like overreach to get those charges reduced to something more reasonable.

I look at the circumstances of the arrest, such as Fourth Amendment violations in traffic stops or warrantless searches. Police will ask to enter homes or vehicles when they lack the authority to do so, because people don’t know their rights or are too intimidated to say no. I am a firm believer in your constitutional rights and making law enforcement play by the rules.

Let’s Protect Your Future

Drug offenses are felony crimes. In addition to jail or prison, that criminal record can make it harder to get employment or housing or financial aid. Call DeMatteo Law Firm for a skilled and spirited defense. I practice in Minnehaha County and surrounding jurisdiction of South Dakota.
